These Terms, the Website Terms of Use, Privacy and Cookies Policy and the Acceptable Use Policy apply to the sale of any Product(s). Please read these Terms carefully before purchasing any Product(s). Please click on the button marked "I Accept" at the end of these Terms if you accept them. If you refuse to accept these Terms, you will not be able to order any Product(s) from our Website. Please print off a copy of these Terms for your records.

www.ezyeducation.co.uk is operated by Ezy Edtech Limited a company registered in England and Wales with Company Number 14050121 whose registered office is Ezy Edtech Ltd, Office C Norland House, 9 Queensdale Crescent, London, England, W11 4TL. VAT Registration Number 412909702.

 

1. Definitions

   1. Fee: means the price for the Product(s) as set out on the Website materials and pricing;

   2. Free Trial: means access to a limited range of materials for a limited period of times set out on the website materials and pricing;

   3. Materials: means the services provided by Ezy Edtech and available to you or your Nominated Person details of which are set out here materials and pricing;

   4. Nominated Person: a person who is not a party to these Terms but who has been nominated by you to use the Product on your behalf;

   5. Package(s): means a combination of the Materials details of which are set out here materials and pricing;

   6. Product: means either a Free Trial, Package or any one of the Materials;

   7. Terms: means these Terms and Conditions;

   8. Website: means http://www.ezyeducation.co.uk

   9. You: means the individual purchasing the Product(s).

2. Order Procedure

   1. When you register for or place an order for any Product(s) you are offering to purchase the Product(s) in accordance with these Terms.

   2. In order to purchase a Product you must register on the Website and be over the age of 18. If you have already registered, you can log into your account using the email address and password that you provide to us when you register.  During the registration process you may request a Nominated Person. You authorise your Nominated Person to access and use the Product(s) on your behalf and acknowledge that any actions of the Nominated Person will be deemed to have been carried out by you.

   3. Although anyone under age 18 (minor person) is not able to purchase a Product or accept the terms, a parent or guardian can accept the terms on their behalf. Acceptance of the terms by the parent or guardian will appoint the minor person as a Nominated Person. The appointment by the parent or guardian will authorise the Nominated Person to access and use the product(s) and acknowledges that any actions taken by the Nominated Person will be deemed to have been carried out by the parent or guardian. 

   4. Upon receipt of your order for a Product(s) you will receive an email confirming that your order has been received by Ezy Edtech. Your order will be subject to acceptance by Ezy Edtech in accordance with clause 2(e) below.

   5. A legally binding agreement shall not come into existence until Ezy Edtech has (i) accepted your offer to purchase the Product(s) by sending you a separate order acceptance confirmation email and (ii) receiving payment for the Product(s) in accordance with clause 3 and/or clause 4.

   6. Ezy Edtech reserves the right to withdraw at anytime any Product(s) advertised for sale on the Website.

3. Payment

   1. The Fee for any Product(s) will be displayed on the Website. The Fee is exclusive of VAT and payment processing fees.

   2. At the point of payment Ezy Edtech will direct you to the secure payment site. Payment processing services are carried out through secure gateways using Paypal.

   3. Ezy Edtech reserves the right from time to time to change the Fees. In the unlikely event that due to a technical error the amount of the Fee displayed on the Website is incorrect Ezy Edtech will notify you as soon as it reasonably can. If the correct Fee is higher than the amount on the Website Ezy Edtech will contact you so you can decide whether or not you wish to continue with your order. If you decide you want to cancel your order Ezy Edtech will give you a refund in full in respect of the any amount you have already paid. If the correct Fee is lower Ezy Edtech will refund you the difference only between the amount which you have paid and the correct Fee payable.

   4. The provision of the Product(s) is subject to Ezy Edtech receiving cleared funds from you.

4. Cancellation

   1. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 ("CCRs") you may cancel your purchase of a Product within a period of 14 working days beginning on the day after the day on which the contract is concluded with you as notified by email from Ezy Edtech in accordance with these Terms. For further details of your rights under the CCR’s you can visit your local Citizens’ Advice Bureau of visit the Office of Fair Trading website.

   2. Your legal right to cancel starts from the date of the email confirmation, which is when the contract between us is formed.

   3. You will receive a full refund of the price you paid for the Product(s). We will process the refund due to you as soon as possible and, in any case, within 30 calendar days of the day on which you gave us notice of cancellation as described in clause 5(a). we will refund you on the credit card or debit card used by you to pay.

5. Product Details and Access

   1. A full description of the Product(s) is available on the Website.

   2. Except as set out in the description of the Product(s) on the Website no additional materials and/or tuition will be provided by Ezy Edtech.

   3. Upon receipt of the confirmation email from Ezy Edtech you will have access to the relevant Product(s).

   4. The Product(s) may only be accessed by you or your Nominated Person. You may not transfer your rights to any other person or provide access to the Product(s) to any other person.

   5. You may incur charges to your internet service provider while you are accessing and/or downloading the Product(s).

   6. Ezy Edtech operates a zero tolerance policy in relation to inappropriate behaviour of students. Ezy Edtech reserve the right to suspend access to the Product(s) if you or the Nominated Person breaches the Acceptable Use Policy.

   7. Access to and use of any Products is also subject to compliance with the Website Terms of Use.

6. System Requirements

   1. Please note it is your responsibility to check that your computer is compatible with the minimum specification requirements that relates to the Product(s) you are ordering, you acknowledge and accept that Ezy Edtech cannot be held responsible for any technical problems you encounter following the purchase of the Product(s).

   2. The minimum system requirements are:-

      1. Broadband connection. Minimum download 1mb, upload 500kb

      2. Browser firefox V19+, Google Chrome V25+, IE V10+

      3. Windows XP / 7, MacOS V9+

7. Service Support

   1. If you have any issues or problems with our Website please complete a contact form on the website outlining the problems you are experiencing.

   2. Ezy Edtech will endeavour to respond to your query within 48 hours of receipt of your email. You acknowledge that at busy times our responses times may be longer but if you do not hear from us within 48 hours please resend your email.

8. Modifications

   From time to time Ezy Edtech may make modifications, enhancements or issue clarifications to the Product(s). You will be provided with access to such changes free of charge to the extent that the changes affect the Product(s) order by you.

9. Warranties

   1. Ezy Edtech will provide the Products(s) in accordance with the description which is set out on the Website.

   2. Ezy Edtech expects you to take reasonable care to verify that the Product(s) ordered by you meet you or your Nominated Person's needs. Ezy Edtech does not make any commitment that you or your Nominated Person will obtain any particular result or obtain any particular qualification from the use of the Product(s).

   3. Ezy Edtech does not make any representation, guarantee or commitment that the Product(s) will be error free.

10. Limitation of Liability

    1. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into the Contract.

    2. We only supply the Product(s) for individual domestic and private use. You agree not to use the Product(s) for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

    3. We do not in any way exclude or limit our liability for:

       1. death or personal injury caused by our negligence;

       2. fraud or fraudulent misrepresentation;

11. Events Outside Our Control

    1. Ezy Edtech will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below in clause 12(b).

    2. An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.

    3. If an Event Outside Our Control takes place that affects the performance of Ezy Edtech obligations:

       1. we will contact you as soon as reasonably possible to notify you; and

       2. our obligations will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.

12. Intellectual Property

    1. Ezy Edtech remain the owner of the intellectual property in the Product(s). No element of the Product(s) may be reproduced, stored or transmitted in any way or by any means without the prior written permission of Ezy Edtech.

    2. In consideration of your payment of the Fee Ezy Edtech grants to you or your Nominated Person a non-exclusive, non-transferrable licence to use the Product(s) ordered on one computer only.

    3. Save as expressly set out in these Terms, you may not modify, copy, reproduce, republish, sub-licence, sell, upload, transmit, make available or distribute in anyway any parts of the Product(s).

13. Data Protection

    1. Ezy Edtech will process the information it receives from you or otherwise holds about you in accordance with these Terms and its Privacy and Cookie Policy.

    2. In the event that you do not wish to receive marketing material from Ezy Edtech a request should be made by completing a contact form on the website.

14. General

    1. Ezy Edtech may update or amend these Terms from time to time to comply with the law or to meet its changing business requirements. Any updates or amendments will be posted on the Website.

    2. These Terms and any matters arising out of or in relation to these Terms are governed and construed in accordance with the laws of England and Wales.
